    Elon Musk has intensified his legal battle against OpenAI, the artificial intelligence firm he co-founded, and its primary backer, Microsoft, accusing the companies of monopolizing the generative AI market. The amended lawsuit, filed in Oakland, California, adds federal antitrust claims to Musk’s case and targets Microsoft as a co-defendant.

    Monopoly Allegations Against AI Giants

    Musk alleges that OpenAI and Microsoft engaged in anticompetitive behavior, leveraging exclusive licensing agreements and restricting partnerships to block rivals from competing effectively. The lawsuit contends that this behavior amounts to an unapproved merger designed to dominate the AI landscape.

    “Microsoft’s anticompetitive practices have escalated,” said Musk’s attorney, Marc Toberoff. “It’s time to shine a light on these actions.”

    The lawsuit calls for OpenAI’s licensing deal with Microsoft to be invalidated and demands the return of profits Musk claims were gained through unfair practices.

    A Shift in OpenAI’s Mission Sparks Dispute

    At the heart of Musk’s grievances is OpenAI’s transformation from a nonprofit organization to a for-profit tech powerhouse, now valued at $157 billion. Musk argues this shift undermined OpenAI’s original mission to prioritize the public good.

    “Never before has a corporation gone from tax-exempt charity to a $157bn for-profit, market-paralyzing gorgon – and in just eight years,” the complaint states.

    The lawsuit emerges as Musk takes on a new government role under President Donald Trump’s incoming administration, focused on reducing wasteful spending. Musk’s contributions to Trump’s campaign and his rising political influence have added a layer of intrigue to the legal battle.

    Critics suggest Musk’s pursuit of the case reflects broader ambitions to reassert control in the AI industry, a sector he helped shape before departing OpenAI in 2018 over disagreements about its trajectory.

    Responses from OpenAI and Microsoft

    OpenAI has dismissed Musk’s claims as meritless, calling the latest lawsuit “even more baseless and overreaching than the previous ones.” Microsoft has chosen not to comment on the ongoing legal proceedings.

    OpenAI has also alleged in court filings that Musk is using the lawsuit as a tool to gain a competitive edge in the growing generative AI market, accusing him of running a “campaign to harass OpenAI.”
